Winters Law Firm is located in Santa Ana, California, the County seat for Orange County, California in which the Superior Courts, the branch of the Federal District Court and the United States Bankruptcy Court are located.
The focus of the firm has been on all areas of commercial and business representation, with a particular emphasis on Business Law, Reorganization, Creditor's Rights, Commercial Real Estate and Bankruptcy. The firm has particular expertise in the area of real estate law and litigation, having represented numerous large real estate developers in commercial projects and secured creditors of commercial projects. The Firm specializes in coordination of legal services for the business client, acting as a conduit for businesses to obtain local and specialized counsel to advise the client and provide representation in any legal situation.
The goal of the firm is to provide quality response to a client's problems as efficiently and economically as possible. Mr. Winters' experience level as well as that of the staff, allows the firm to respond to clients' concerns without duplication of effort or charging the clients for "training" of firm employees. The Firm maintains contact with a network of other attorneys and professionals with expertise in areas such as tax law, corporations, trusts and general litigation.
Principal tenets of the firm's operating philosophy include: (a) full and candid client communication, (b) a team concept between attorney and client and (c) quick and effective problem resolution, resulting in a savings in legal expenses.
In the area of real estate representation, since 1983 Mr. Winters represented numerous regional shopping centers regarding their commercial and tenant litigation and Creditor Bankruptcy matters.
In the area of Reorganization, Mr. Winters has primarily represented secured creditors and small business debtors in Court Reorganizations and out of court workouts and negotiations. The Firm also has wide experience in the area of Federal Appeals. Representative published cases include American Express v Hashemi, 104 F. 3d. 1122, In re Mercado, 124 B.R. 799.

DENNIS WINTERS
Dennis Winters graduated from California State University, Fullerton with a B.A. in 1974, and Loyola Law School, Los Angeles with a J.D. in 1979, where he earned the AmJur Award in Evidence, He was admitted to the Bar in 1979. He has specialized in real estate, commercial law and bankruptcy matters since 1980, initially with the firm of Alberts & Minier, and thereafter as a principal of Minier & Winters. Commencing in April, 1992, he started his own firm, the Winters Law Firm.
Mr. Winters is an expert in representation of businesses in commercial litigation and in particular, commercial real estate land owners. Over the last 15 years he has represented dozens of commercial real estate owners and developers in litigation, including over 100 landlord tenat lawsuits.
Mr. Winters has had extensive experience representing creditors, debtors, Trustees and Creditor's Committees in Bankruptcy Court. He has successfully handled all types of Bankruptcy proceedings, from Motions for Relief from Stay to Chapter 11 Plans and Disclosure Statements. He has also represented both Defendants and Plaintiffs in numerous Adversary proceedings, including Preference, Fraudulent Transfer actions and Non-Dischargeability actions.
Mr. Winters is a member of the Real Estate, Commercial Law and Bankruptcy Sections of the Orange County Bar Association, the Los Angeles Bar Association and Orange County Bankruptcy Forum. |
